How are advance payments protected when buying off-plan in Spain?

Spanish law provides protections for qualifying advance payments on homes under construction. Applicable buyer funds are handled through a special account separated from the developer’s other funds, and qualifying advance payments must be protected through the prescribed guarantee or insurance mechanism where the legal conditions apply.

Have your independent lawyer verify the protection and individual guarantee applying to your payments.

Why does the developer's track record matter?

When buying off-plan, you are partly buying the developer’s ability to deliver it.

Look at previous developments, build quality several years after completion, delivery history, reputation and financial strength. If possible, visit one of their older completed projects.

The glossy brochure is not due diligence.

What happens if a Marbella new development is delayed?

Always allow for the possibility that the delivery date moves. Licences, approvals, utilities and administrative procedures can still introduce uncertainty.

Your lawyer should explain the contractual completion date, any permitted grace period and remedies for delay.

FUNDING

Can you get a mortgage on an off-plan property?

Potentially, but do not build your purchase around the assumption that mortgage funding will simply appear at completion.

Work through the reservation payment, staged payments, taxes, costs, final balance and realistic finance before committing.

What taxes do you pay on a new-build property in Andalucía?

For a standard first transmission of a newly built home in Andalucía, the purchase is generally subject to 10% VAT (IVA). The public deed is also generally subject to AJD, whose general rate in Andalucía is currently 1.2%.

At €1,000,000, those two taxes alone amount to €112,000 before other applicable costs.

We would. An independent lawyer should explain the contract, payment protections, completion provisions and development documentation from your side.

There is a useful difference between “they told me” and “my lawyer checked it and explained exactly what it says”.

Should you arrange independent snagging before handover?

Inspect properly and understand the procedure and timeframe for reporting defects.

Snagging can cover cosmetic finishes as well as doors, glazing, plumbing, drainage, electrics, air conditioning and terraces.

You paid for a new property. Expect it to be delivered to the agreed standard.

THE AMENITIES BILL

Why should you check community fees before buying?

The brochure may advertise security, a spa, gym, pools, concierge, coworking areas and landscaped gardens.

Those amenities can be excellent if you use them. But the owners pay for them.

Amenities are not free because they are communal.

INVESTMENT REALITY

Is buying early in a new development a good investment?

It can be, but separate the investment thesis from the sales pitch. Your real result is the net return after acquisition costs, holding costs, selling costs and taxes.

If you sell at the same price you bought for, you can still lose money because you entered the transaction with taxes and costs.

Can you assume a new-build apartment can be used for holiday rentals?

No. If short-term rental income is part of the investment case, verify the rules before buying.

Tourist accommodation in Andalucía is regulated, municipal planning rules apply and community approval requirements can be relevant.

“I’ll Airbnb it when I’m not there” is not an investment plan until you’ve verified that you actually can.
