Is buying a new-build property in Marbella a good idea?​

Buying new or off-plan in Marbella can make sense if you value modern specifications, lower early-stage pricing, staged payments, less immediate maintenance and access to the best units. The trade-off is that the earlier you buy, the less you can physically inspect and the more you rely on the developer, contract, build quality and delivery timetable.

Earlier can mean greater potential upside but it also means greater uncertainty.

New does not automatically mean luxury. Location, space, ceiling heights, materials, build quality, privacy, amenities and long-term standards still matter more than the fact a property is new.

Why are buyers choosing new developments in Marbella?

New developments appeal for contemporary layouts, better energy performance, modern systems, pools, gyms, spas, coworking facilities, security and less immediate maintenance.

Early phases can offer the widest choice of units and sometimes more attractive launch-stage pricing.

But a later asking price is not the same thing as guaranteed profit.

DO NOT BUY THE RENDER

Why should you never buy from the renders alone?

Modern CGI is excellent at selling a vision: perfect light, mature landscaping, immaculate pools and carefully framed views.

Visit the site even if there is almost nothing there yet. Check orientation, road noise, access, gradient, surrounding plots, future construction and real journey times.

LOCATION FIRST

Does location still matter more than the development?

For a lifestyle purchase, usually yes. A spectacular new development can tempt buyers into compromising on location because the property looks better for the money.

A beachfront apartment in Manilva and a beachfront apartment in Marbella are not the same proposition simply because both are beachfront.

WHAT IS LUXURY?

Does new-build mean luxury?

No. New is an age; luxury is a standard.

True luxury still comes back to location, room sizes, ceiling heights, materials, build quality, privacy, specification, landscaping, amenities and how well the property performs years after completion.

THE BUYING PROCESS

How does buying an off-plan property in Spain usually work?

The exact structure varies by developer and contract, but buyers commonly encounter a reservation stage, a private purchase contract, staged payments during construction and a final balance at completion.

YOUR MONEY

How are advance payments protected when buying off-plan in Spain?

Spanish law provides protections for qualifying advance payments on homes under construction. Applicable buyer funds are handled through a special account separated from the developer’s other funds, and qualifying advance payments must be protected through the prescribed guarantee or insurance mechanism where the legal conditions apply.

Have your independent lawyer verify the protection and individual guarantee applying to your payments.

DEVELOPER DUE DILIGENCE

Why does the developer's track record matter?

When buying off-plan, you are partly buying the developer’s ability to deliver it.

Look at previous developments, build quality several years after completion, delivery history, reputation and financial strength. If possible, visit one of their older completed projects.

The glossy brochure is not due diligence.

TIMELINES

What happens if a Marbella new development is delayed?

Always allow for the possibility that the delivery date moves. Licences, approvals, utilities and administrative procedures can still introduce uncertainty.

Your lawyer should explain the contractual completion date, any permitted grace period and remedies for delay.

FUNDING

Can you get a mortgage on an off-plan property?

Potentially, but do not build your purchase around the assumption that mortgage funding will simply appear at completion.

Work through the reservation payment, staged payments, taxes, costs, final balance and realistic finance before committing.
It is also worth doing some research into new-build options at different budgets.

THE REAL COST

What taxes do you pay on a new-build property in Andalucía?

For a standard first transmission of a newly built home in Andalucía, the purchase is generally subject to 10% VAT (IVA). The public deed is also generally subject to AJD, whose general rate in Andalucía is currently 1.2%.

At €1,000,000, those two taxes alone amount to €112,000 before other applicable costs.

INDEPENDENT ADVICE

Should you use your own independent lawyer?

We would. An independent lawyer should explain the contract, payment protections, completion provisions and development documentation from your side.

There is a useful difference between “they told me” y “my lawyer checked it and explained exactly what it says”.

HANDOVER

Should you arrange independent snagging before handover?

Inspect properly and understand the procedure and timeframe for reporting defects.

Snagging can cover cosmetic finishes as well as doors, glazing, plumbing, drainage, electrics, air conditioning and terraces.

You paid for a new property. Expect it to be delivered to the agreed standard.

THE AMENITIES BILL

Why should you check community fees before buying?

The brochure may advertise security, a spa, gym, pools, concierge, coworking areas and landscaped gardens.

Those amenities can be excellent if you use them. But the owners pay for them.

Amenities are not free because they are communal.

INVESTMENT REALITY

Is buying early in a new development a good investment?

It can be, but separate the investment thesis from the sales pitch. Your real result is the net return after acquisition costs, holding costs, selling costs and taxes.

If you sell at the same price you bought for, you can still lose money because you entered the transaction with taxes and costs.

A lot of people also then consider planning interior design changes to new properties, to personalise it before moving in. 

HOLIDAY RENTALS

Can you assume a new-build apartment can be used for holiday rentals?

No. If short-term rental income is part of the investment case, verify the rules before buying.

Tourist accommodation in Andalucía is regulated, municipal planning rules apply and community approval requirements can be relevant.

“I’ll Airbnb it when I’m not there” is not an investment plan until you’ve verified that you actually can.

HOW TO BUY

Should you buy directly from the developer or use an estate agent?

If you know exactly which development you want, going direct can be perfectly reasonable.

The limitation is that the developer sells that development. A good independent adviser can compare it with competing projects, completed new-builds, renovated resales and different areas, giving you a complete Marbella property purchase steps.
